The cell phone has no reception.  Issue: Can the wife use the Ham radio to call for help?

FCC LAURA SMITH STATES: “there is no situation where the amateur rules would authorize unlicensed use.” “…an unlicensed individual may not operate an amateur radio under any circumstances. If they do so, they are in violation of the Communications Act and the Commission’s rules and subject to a possible enforcement action”. 

FCC (Laura Smith) HAS SENTENCED THE WIFE TO DEATH.

PROOF LAURA SMITH-FCC IS LYING. FCC LEGAL COUNSEL SAID YES, THE NON HAM WIFE IN THE AUTO ACCIDENT CAN USE THE HAM RADIO (See Exhibit I, below). SMITH FCC IS LYING ABOUT THE ACTUAL RULES. SMITH IS INVENTING HER OWN RULES. YOUR NON HAM FAMILY MEMBER AND NEIGHBORS MAY BE NEXT. MAYBE EVEN YOU AS A HAM WILL SEE THE LIGHT WHEN THE ONLY PERSON WHO HEARD YOUR EMERGENCY CALL FOR HELP IS A NON HAM MONITORING.

MORE EXAMPLES OF NON HAMS USING HAM RADIO AS ALLOWED BY FCC. MORE PROOF THAT SMITH FCC IS LYING.

 1. Grandpa (Ham) has his grandchild (NOT a Ham) on his lap. The Grandchild (NON Ham)  talks on Grandpa's Ham Radio (and is talking on the Ham Repeater / control operator at Control Point). The NON Ham Grandchild is allowed to talk on the Ham Repeater (NON EMERGENCY).

 2.  A Ham Places a telephone call from his radio (using the Ham Repeater) and dials 911.  The 911 operator is NOT a Ham. The Repeater is set up for Autopatch (which in this case links the Ham Repeater to the telephone lines).  The 911 operator, although not a Ham, is allowed to talk on the Ham Repeater (IT IS AN EMERGENCY, BUT THE 911 OPERATOR  IS NOT A HAM).

 3.  A Ham orders a PIZZA using his ham radio and places the call through the Ham Repeater to order that Pizza. The Repeater is set up for Autopatch (which in this case links the Ham Repeater to the telephone lines).The Pizza Shop employee is NOT a Ham., but is allowed to talk on the Ham Repeater (NON EMERGENCY).  

In each of the above cases a  NON HAM is using the Ham Repeater for communicating. Each is legal.

WHY IS LAURA SMITH (FCC LYING)  AND ORDERING THAT NON HAMS CAN NEVER USE THAT VERY SAME HAM REPEATER  TO SAVE LIFE (E.G., WILDFIRES, FLOODS, EARTHQUAKES, ETC... )? THAT IS  EVEN WHEN THE CONTROL OPERATOR OF THE REPEATER IS AT THE CONTROL POINT.

The response also illuminates that the standard of reasonableness is to be used in evaluating the use of Ham Radio taking into account the circumstances. Further, a case by case evaluation is made of the circumstances; and a fact specific determination is made as to the existence of an emergency. Such further confirmed that the prior statements made by various persons at the FCC advising that “there is no provisions in the Rules that would allow unlicensed use in the amateur bands”, were erroneous and not correct.
